1. Introduction

1.1 These Terms & Conditions (“Terms”) govern your use of the Carousel Fine Art website, your purchase of artworks, and any consignment or commission agreements with us (“the Gallery,” “we,” “us,” “our”).
1.2 By accessing our website, placing a deposit, making a purchase, or entering any agreement with the Gallery, you acknowledge and accept these Terms in full.
1.3 If you do not agree, you must not use our website or proceed with any transaction.

 

2. Definitions

  • Artwork / Work: Any original art, limited edition, sculpture, print, or creative work offered for sale or consignment.

  • Client / Buyer / You: Any individual or entity purchasing, consigning, or interacting with the Gallery.

  • Sale: Any purchase, consignment sale, commission, or transaction involving Artwork.

 

3. Sales & Authenticity

3.1 The Gallery guarantees it has the right to sell or consign each Artwork, either through ownership or written authorization from the artist/owner.
3.2 All information regarding authenticity, provenance, condition, attribution, or value reflects our professional good-faith opinion.
3.3 Buyers are strongly encouraged to request additional information, photos, videos, or condition reports before purchasing.

 

4. Payment Terms & Deposits

4.1 We may require deposits to reserve Artwork, initiate commissions, or begin payment plans.
4.2 All deposits are strictly non-refundable. Once paid, an Artwork is removed from public availability and reserved for the Buyer.
4.3 Artwork will not be released until all balances—including taxes, shipping, insurance, framing, installation, or special services—are fully paid.

 

5. Final Sale Policy

5.1 All sales are final. No returns, refunds, cancellations, or exchanges will be accepted once a transaction has been completed.
5.2 Buyer remorse, aesthetic dissatisfaction, size issues, color concerns, or changes of preference do not qualify for returns.
5.3 Exceptions may only be made if Carousel Fine Art, at its sole discretion, identifies material misrepresentation or damage directly caused by us prior to shipping.

 

6. Commissioned Artwork & Custom Orders

6.1 Commissioned artworks are produced specifically for the Client.
6.2 Commission payments, retainers, and balances are non-refundable under all circumstances.
6.3 Commissioned artworks cannot be exchanged once completed or once the artist has begun work.
6.4 Any changes requested by the Client after production begins may incur additional costs at the Gallery’s discretion.

 

7. Consignment Terms (For Artists & Owners)

7.1 Consignment relationships are governed by a separate written agreement signed by both parties.
7.2 Consignment commission percentages and fees are binding once agreed and cannot be refunded or altered retroactively.
7.3 Consigned Artwork remains the property of the artist/owner until the Gallery receives full payment from the Buyer.
7.4 The Gallery determines final retail pricing unless otherwise specified in writing.

 

8. Shipping, Delivery & Handling

8.1 Carousel Fine Art offers shipping assistance as a courtesy, using reputable and professional third-party art shippers, freight services, or carriers.
8.2 While we always aim to deliver Artwork safely, promptly, and with the highest standards, some factors are outside our control.
8.3 The Gallery is not responsible for delays, damage, loss, or mishandling caused by third-party shippers.
8.4 Shipping timelines provided by us or by a carrier are estimates only—not guarantees. Delays may occur due to:

  • Weather

  • Customs

  • Carrier backlog

  • Logistics interruptions

  • Handling by third-party delivery teams
    8.5 Once Artwork leaves our possession, risk transfers to the Buyer or the shipping carrier (depending on the carrier’s terms).
    8.6 Clients are responsible for purchasing additional insurance if desired.
    8.7 Any shipping claims (delay, damage, etc.) must be filed directly with the carrier unless otherwise specified.

 

9. Website Use & Intellectual Property

9.1 All images, content, descriptions, videos, and materials on this website are the intellectual property of Carousel Fine Art or its artists.
9.2 No content may be copied, reproduced, distributed, or used commercially without written permission.
9.3 Purchased Artwork grants the Buyer ownership of the physical piece only—not the copyright.

 

10. Limitation of Liability

10.1 The Gallery is not liable for indirect, incidental, or consequential damages arising from website use, purchase, consignment, or shipping.
10.2 This includes, but is not limited to:

  • Loss of value

  • Missed delivery deadlines

  • Personal dissatisfaction

  • Business interruption

  • Damage during third-party transit

 

11. Amendments

11.1 The Gallery may revise or update these Terms at any time without prior notice.
11.2 The version posted on the website at the time of purchase or consignment will apply.

 

12. Governing Law

These Terms are governed by the laws of the state in which Carousel Fine Art is headquartered (Florida), without regard to conflict-of-law provisions. Any disputes shall be resolved in that jurisdiction unless otherwise agreed.

By using our website, placing a deposit, completing a purchase, or entering a consignment or commission agreement, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
